Terms of Service for Fibecheck
These Terms of Service govern your use of the Fibecheck app and the website at fibecheck.app. By downloading, installing, or using Fibecheck, you agree to these terms.

About Fibecheck
Fibecheck is a knitting and crochet organizer app developed and operated by Curtis Duggan Software ("we," "us," or "our"). Fibecheck helps you import patterns, track projects, manage your yarn stash, and stay organized while you make. The app is available on iPhone and iPad through the Apple App Store.
Acceptance of terms
By accessing or using Fibecheck, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app or website. We may update these terms from time to time, and your continued use of Fibecheck after changes are posted constitutes acceptance of the updated terms.
Eligibility
You must be at least 13 years old to use Fibecheck. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these terms on your behalf. By using Fibecheck, you represent and warrant that you meet these eligibility requirements.
Your account and data
Fibecheck stores your data locally on your device. If you subscribe to Fibecheck Pro, your data may sync across your Apple devices using Apple's cloud services. You are responsible for maintaining the security of your device and any data stored in the app.
We do not require you to create an account to use Fibecheck. Subscriptions and purchases are managed through your Apple ID and the App Store.
License to use Fibecheck
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Fibecheck on Apple devices that you own or control, for your personal, non-commercial use. This license is also subject to the Apple Media Services Terms and Conditions and the Usage Rules set forth in those terms.
You may not:
- Copy, modify, distribute, sell, or lease any part of the app or its content.
- Reverse engineer, decompile, or disassemble the app, except where applicable law expressly permits.
- Remove, alter, or obscure any proprietary notices in the app.
- Use the app for any unlawful purpose or in violation of these terms.
Your content
You retain ownership of any content you create or import into Fibecheck, including patterns, project notes, photos, stash entries, and other data. We do not claim any ownership rights over your content.
You are solely responsible for the content you store in Fibecheck. You represent that you have the necessary rights to any patterns, images, or other materials you import into the app. We are not responsible for any intellectual property disputes related to content you import or store.
We recommend keeping backups of any important data. While we take reasonable steps to protect your data, we cannot guarantee against data loss.
Subscriptions and payments
Fibecheck offers both free and paid features. Fibecheck Pro is available as a subscription that unlocks additional features such as unlimited projects, unlimited pattern imports, and sync across devices.
- Subscriptions are billed through the Apple App Store and are subject to Apple's terms and pricing.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your Apple ID account settings.
- Refunds are handled by Apple in accordance with their refund policies.
We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing period after the change, and you will be notified in advance through the App Store.
Prohibited uses
You agree not to:
- Use Fibecheck in any way that violates applicable local, provincial, national, or international law.
- Attempt to interfere with, compromise, or disrupt the app, its servers, or connected networks.
- Use the app to transmit any malicious code, viruses, or harmful data.
- Attempt to gain unauthorized access to any part of the app or its systems.
- Use the app in any manner that could damage, disable, overburden, or impair our services.
- Use automated means to access or interact with the app without our prior written consent.
Intellectual property
Fibecheck, including its design, interface, code, graphics, logos, and documentation, is the property of Curtis Duggan Software and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these terms are reserved.
The Fibecheck name and logo are trademarks of Curtis Duggan Software. You may not use our trademarks without prior written permission.
Disclaimers
Fibecheck is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any data stored in the app will be preserved indefinitely or that sync features will function without interruption.
Limitation of liability
To the fullest extent permitted by applicable law, Curtis Duggan Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, business, or goodwill, whether arising from contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claims arising from or related to these terms or your use of Fibecheck shall not exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or fifty Canadian dollars (CAD $50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Curtis Duggan Software from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of Fibecheck, your content, your violation of these terms, or your violation of any rights of a third party.
Termination
You may stop using Fibecheck at any time by deleting the app from your devices. We may suspend or terminate your access to Fibecheck at any time, with or without cause, and with or without notice.
Upon termination, your license to use Fibecheck ends immediately. Sections of these terms that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
Governing law and disputes
These terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from or relating to these terms or your use of Fibecheck shall be resolved exclusively in the courts of the Province of British Columbia, and you consent to the personal jurisdiction of those courts.
Nothing in these terms limits any rights you may have under applicable consumer protection laws in your jurisdiction that cannot be waived or limited by contract.
Changes to these terms
We may update these Terms of Service from time to time. When we make changes, we will update the effective date at the top of this page. If we make material changes, we will provide notice through the app or website. Your continued use of Fibecheck after changes are posted constitutes acceptance of the updated terms.
